Terms of Use
These terms are an agreement between you and [Operator name] ("we", "us"), the operator of BigBack. By creating an account you agree to them, to our Community Guidelines and to our Privacy Policy.
1. Who can use BigBack
- You must be at least 16 and have a valid @uwaterloo.ca email address (we may open other schools later).
- One account per person. Keep your sign-in codes to yourself. You're responsible for activity on your account.
- Give accurate information, and don't impersonate anyone.
2. Zero tolerance for objectionable content and abusive users
BigBack has no tolerance for objectionable content or abusive behaviour, as described in the Community Guidelines. This includes hate, harassment, bullying, sexual content, threats, and sharing someone's private information. You can report any post, comment or profile, and block any user. We review reports within 24 hours. We remove content that breaks the rules and suspend or permanently remove the people who post it.
3. Your content
- You own what you post. You give us a worldwide, non-exclusive, royalty-free licence to host, store, display and share it within BigBack, and in invite links you create, so the app can work. The licence ends when you delete the content or your account, except for copies others already shared in plans you were part of, and backups for a limited time.
- Only post content you have the right to post. Ask before posting other people's faces, and take a post down if someone in it asks you to.
- Ratings must be honest and based on your own visit. No paid or fake reviews, and don't rate a place you own, work at or are paid by.
- We may remove content or limit accounts that break these terms or the Guidelines.
4. Places, reservations and other services
- Restaurant details, maps and directions come from Apple Maps and other sources and may be out of date. Check hours, prices and allergen information with the restaurant.
- Reservations and links to OpenTable, Resy, Google Maps or Yelp are handled by those services under their own terms. We aren't responsible for their bookings or content.
- Ask BigBack suggestions are generated by AI from BigBack data and can be wrong. They aren't dietary, medical or allergy advice.
5. Using BigBack fairly
Don't misuse the service. No scraping, automated accounts, spam, reverse engineering, attempts to get around blocks or privacy settings, or breaking the law. Don't use BigBack to advertise without our permission.
6. Ending your account
You can delete your account at any time in the app (You → Account → Delete account). We may suspend or end accounts that break these terms. Sections 3 (as to the licence ending), 7, 8 and 9 survive.
7. Disclaimers
BigBack is provided "as is". To the extent the law allows, we don't promise it will be uninterrupted or error-free, or that any content on it, including other users' ratings, is accurate.
8. Limitation of liability
To the extent the law allows, we aren't liable for indirect or consequential losses, or for anything other users post. Our total liability for any claim is limited to CAD $100. Nothing here limits rights you have under consumer protection law that can't be waived.
9. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes go to the courts of Ontario, unless your local consumer law gives you the right to go to court where you live.
10. Changes
If we change these terms in a meaningful way, we'll tell you in the app and ask you to accept them again before you continue.
11. Apple App Store terms
If you downloaded BigBack from Apple's App Store:
- These terms are between you and us, not Apple. Apple isn't responsible for BigBack or its content.
- Your licence to use the app is limited to Apple-branded devices you own or control, as the App Store's Usage Rules allow.
- Apple has no obligation to provide maintenance or support for BigBack. Contact us instead.
- If the app fails to meet any applicable warranty, you can notify Apple, and Apple may refund the purchase price, if any. Apple has no other warranty obligation for the app.
- Apple isn't responsible for any claims about the app, including product liability, legal or regulatory compliance, consumer protection, privacy, or claims that the app infringes someone's intellectual property. We are responsible for those, as these terms describe.
- You confirm you aren't in a country subject to a U.S. Government embargo, and aren't on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
